HELP NEEDED for Javier Suarez Medina
on death row in Polunsky Unit, Texas since 13 years-
On death row, they have let him become an adult man ... - just to kill him now ? ? ?
Dear Visitors, This is an urgent appeal which has a very special meaning to me, because it's an appeal for my pen-pal and truly friend on death row in Texas, Javier Medina. On January 16, the 5 th circuit of appeals turned him down. He will become 33 years old on June 17. Now judge Strickland (Tx) has set an execution date for Javier on August, 14th ! His attorney has currently filed a clemency request to the Texas board of pardons and parole.

He isn't the man who'd hurt other people. He cares for his family and for other inmates on the Unit, he respects life and he deeply believes in God and Jesus Christ. He is neither a cold-hearted killer nore a incorrigible criminal If the Supreme Court turns his last appeal down, his death warrant will be undersigned soon. The last decision to stop his execution or to grant clemency to him is the Governor. But - the Texas Governor, Rick Perry, strictly believes in the death penalty and recently vetoed to spare mentally retarded people from being executed.
So, his chances to recieve a clemency recommendation are slight. Because
his family is poor and the funeral
costs are between $ 1,5000 and 2,000, Javier wants to help his parents to be

Case information: Javier Suarez Medina was accused for shooting an undercover police officer during a faked at the age of 19. His death sentence was only based on the materially unreliable testimony of an eye witness (Mr Mesley) whose testimony came up two years after the crime happened when Mr Mesley saw Medina’s face on TV. Mesley said that Medina had robbed and injured him and his wife two years ago. He claimed that he had recognized him, a young hispanic male he 'saw' ten or fifteen feet from a street light and for "around a minute". Additionally, almost two years elapsed between the extraneous unadjucated offense and the initial confrontation when he saw a broadcast picturing Medina's face. Knowing the evidence in the guilt / innocence phase was not enough to win a sentence of death and because Mr Medina had no criminal record at all – neither misdemeanors nor felonies – in it’s initial presentation of the punishment phase, the prosecution was reduced to making allegations that Medina: a) refused to obey the
instructions of a principal to leave a elemtary school campus
b) failed to obey a
school official to leave an area where other students where
c) that he was
counseled because he went upstairs after being told not to do so, and that
he d) ran past a friend or
neighbor and allegdly made the statement that he “was going to get a
car” e) was with three others in an automobile that was stolen The jury refused to vote for the death penalty. When the prosecution learned about the Mesley shooting incident, they seized on it to reopen the punishment phase even after both the defense and the prosecution had rested. Due to this, Medina got the death penalty, than.
Please send letters to the Mexican President and the Mexican Consul in Texas and urge them to intervene for him. Mention that: - Mexico has abolished the death penalty and
that his death sentence violated the Vienna Convention on Consular Relations, because Medina was not told
that he had a right to contact the
nearest Mexican consulate for legal advice after his arrest. - Medina was not a professional
drug-trafficker and had no criminal record at all, neither misdemeanors nor
felonies, when being accused for murder. - the standards of the Universal Declaration of Human
Rights declare
the death penalty as an inhumane, unusual and degrading form of punishment. Ask them to use their political power to save Medina's life and thank him for paying attention to your appeal.
